ISLAMABAD – A legal war over judge seniority erupted in the Islamabad High Court, with five judges filing a petition with the Supreme Court challenging the seniority list.
The case, filed by Justices Mohsin Akhtar Kayani, Tariq Mahmood Jahangiri, Babar Sattar, Sardar Ejaz Ishaq Khan, and Saman Rafat Imtiaz, challenges the seniority.
The petition, spanning 49 pages, was presented under Article 184(3) by prominent legal counsel Munir A. Malik and Barrister Salahuddin.
The petition asks the Supreme Court to rule that the president does not have unrestricted jurisdiction under Article 200(1) to transfer justices between high courts without sufficient public interest. It claims that such transfers should not be made randomly.
Furthermore, the petition seeks that three transferred judges be suspended from their responsibilities and that Justice Sarfraz Dogar be barred from functioning as acting Chief Justice.
Previously, the five justices had sought the legal advice of Munir A. Malik and Barrister Salahuddin to contest the seniority judgment.
It is worth noting that former IHC Chief Justice Aamer Farooq already questioned the seniority representation of these five justices.
Their petition was first submitted in opposition to the decision to appoint Justice Sarfraz Dogar as the senior puisne judge.
